ARTICLE 1
— DEFINITIONS
For the purposes of these Terms of Use:
Carnet Top means the web platform operated by Groupe Maserdan Inc.
Member means any person whose registration has been accepted.
Points means the virtual units awarded to members under the program.
Reward means a discount, gift, special offer or any other benefit that may be obtained using points.
Partner merchant means any business participating in the Carnet Top program.
TopClub Rabais means the section of the site where rewards offered to members are published.
ARTICLE 2
— ACCEPTANCE OF THE TERMS
Use of the Carnet Top site implies full acceptance of these Terms of Use.
Anyone who creates an account confirms that they have read, understood and accepted these terms.
ARTICLE 3
— PURPOSE OF THE PROGRAM
Carnet Top is a free loyalty program that allows members, among other things:
- to become a member;
- to take part in various games and activities;
- to accumulate points;
- to obtain discounts;
- to obtain certain gifts;
- to benefit from offers proposed by partner merchants.
ARTICLE 4
— ELIGIBILITY
The program is offered to residents of Canada.
The member must provide accurate information at registration.
Carnet Top may refuse any registration considered incomplete, fraudulent or non-compliant with these Terms of Use.
ARTICLE 5
— REGISTRATION
Registration is free.
Depending on distribution campaigns, a registration code may be required to create an account.
Each person may hold only one account, unless written authorization is given by Carnet Top.
ARTICLE 6
— REGISTRATION CODE
The code distributed by Carnet Top is personal.
Each code may be used only once.
Carnet Top reserves the right to cancel any code obtained or used fraudulently.
ARTICLE 7
— USER ACCOUNT
The member is responsible for:
- the confidentiality of their password;
- activities carried out under their account;
- the accuracy of the information provided.
The member must notify Carnet Top of any unauthorized use of their account.
ARTICLE 8
— MEMBER OBLIGATIONS
The member agrees, among other things, to:
- comply with these Terms of Use;
- use the site in good faith;
- not attempt to circumvent the rules;
- not create multiple accounts;
- not use automated software.
ARTICLE 9
— AWARDING OF POINTS
Points may be awarded, among other things:
- when participating in a game;
- during certain promotions;
- during special activities;
- under any other method announced by Carnet Top.
Carnet Top remains solely responsible for the calculation, validation and awarding of points.
ARTICLE 10
— USE OF POINTS
Points:
- have no monetary value;
- may not be sold;
- may not be transferred;
- may not be exchanged for money.
They serve only to obtain the rewards offered under the program.
ARTICLE 11
— OFFERS, DISCOUNTS AND GIFTS
Rewards offered by partner merchants may include:
- discounts;
- products;
- gifts;
- services;
- experiences.
Each offer specifies, among other things:
- the number of points required;
- the validity period;
- available quantities, where applicable;
- special conditions.
Gifts and discounts offered in limited quantities are awarded on a first-come, first-served basis.
ARTICLE 12
— CLAIMING REWARDS
Having enough points does not automatically reserve a reward.
A reward is awarded only when:
- the request is completed;
- availability is confirmed;
- the transaction is validated by the Carnet Top system.
Gifts must be collected from the merchant or according to the terms indicated on the offer page.
Rewards not claimed within the stated period may be cancelled without compensation.
ARTICLE 13
— GAMES
Games offered on Carnet Top are intended for entertainment.
Carnet Top may modify, suspend or withdraw a game at any time.
Any fraud results in cancellation of the points concerned and may result in account closure.
ARTICLE 14
— FAIR USE
Any attempt at fraud, manipulation, automation or exploitation of a technical error is prohibited.
Carnet Top may suspend an account, cancel points or permanently close an account when circumstances justify it.
ARTICLE 15
— ACCOUNT SUSPENSION OR CLOSURE
Carnet Top may suspend or close an account, including in cases of:
- fraud;
- abusive use;
- false information;
- non-compliance with these Terms of Use.
ARTICLE 16
— COMMUNICATIONS AND NEWSLETTER
The member may choose to subscribe to the Carnet Top newsletter.
Subscribed members may receive advance information about new gifts, discounts and promotions.
This information may allow them to prepare to accumulate the points needed before certain limited-quantity offers go live.
Subscription is optional and may be cancelled at any time.
ARTICLE 17
— PROTECTION OF PERSONAL INFORMATION
Personal information is processed in accordance with the Carnet Top Privacy Policy.
ARTICLE 18
— CARNET TOP LIABILITY
Carnet Top acts as administrator of the program.
Carnet Top does not guarantee the permanent availability of rewards or the uninterrupted operation of the site.
ARTICLE 19
— MERCHANT LIABILITY
Each partner merchant remains responsible for:
- products;
- services;
- warranties;
- after-sales service;
- compliance with applicable laws.
ARTICLE 20
— TECHNICAL ERRORS
Carnet Top may correct, without notice, any error concerning:
- a description;
- a photograph;
- a number of points;
- an available quantity;
- a date;
- an offer.
A manifest error creates no vested right.
ARTICLE 21
— PROGRAM CHANGES
Carnet Top may modify the program, rewards, games, partners or the number of points required.
Any claim already confirmed remains valid under the conditions in effect at the time of its confirmation.
ARTICLE 22
— INTELLECTUAL PROPERTY
The Carnet Top name, logos, texts, images, videos, games and all platform content are the property of Groupe Maserdan Inc. or their respective owners.
Any reproduction without written authorization is prohibited.
ARTICLE 23
— GOVERNING LAW
These Terms of Use are governed by the laws of the province of Quebec and applicable Canadian laws.
ARTICLE 24

ARTICLE 25
— FINAL PROVISIONS
If any provision of these Terms of Use is declared invalid or unenforceable, the remaining provisions remain fully in force.
These Terms of Use take effect upon their publication on the Carnet Top platform.
